Standard Terms and Conditions of Sale

These Terms and Conditions govern all sales of food, beverages, catering services, products, and events by Sinq Foods Pty Ltd ("Sinq Foods", "we", "us") to customers and clients ("you", "the client"). By placing an order, making a booking, or accepting our services, you agree to these Terms.

1. Agreement to Terms

The client expressly accepts these Terms and waives any conflicting standard terms of their own, even where those terms were drawn up after these Terms. Any variation must be agreed in writing by an authorised representative of Sinq Foods Pty Ltd.

2. Payment Terms

Point of sale (restaurant and food truck)
Payment is due in full at the time of purchase. We accept cash, EFTPOS, and major credit cards. Cash payments are rounded to the nearest $0.05 in accordance with Australian currency regulations.

Catering and events
A non-refundable deposit of 50% is required upon booking confirmation. The balance is due on the day of service unless otherwise agreed in writing. Invoices unpaid within 30 days attract a late payment fee of 10% per annum on the outstanding balance, calculated daily.

Wholesale accounts
Payment is due within 30 days of invoice date. Sinq Foods reserves the right to suspend supply to accounts with outstanding overdue balances.

3. Debt Recovery

If payment remains outstanding for more than 60 days, Sinq Foods reserves the right to engage a debt recovery agency. All reasonable costs of recovery, including legal fees, are payable by the client.

4. GST and Tax Invoices

All prices are exclusive of GST unless stated otherwise. GST at 10% will be added to all taxable supplies. A valid tax invoice including ABN 32 690 035 691 will be issued for all taxable supplies.

5. Allergen Notice

Sinq Foods prepares food in a kitchen that handles nuts, gluten, dairy, sesame, eggs, and other common allergens. While we take care to accommodate dietary requirements, we cannot guarantee a completely allergen-free environment. Please inform us of any allergies before ordering. Sinq Foods accepts no liability for allergic reactions arising from failure to disclose allergen requirements.

6. Catering Cancellation Policy

  1. Cancellation more than 7 days before the event: full refund of deposit.
  2. Cancellation within 7 days of the event: deposit is forfeited.
  3. Cancellation within 48 hours: full invoice amount is payable.
  4. No-show on the day: full invoice amount is payable.

Cancellations must be notified in writing to info@sinqfoods.com.au.

7. Service Standards and Liability

Sinq Foods will use its best endeavours to supply services and products in accordance with agreed specifications. To the extent permitted by Australian Consumer Law, our liability is limited to the value of the relevant order or booking.

8. Third-Party Delivery Platforms

For orders placed via DoorDash, Uber Eats, or other delivery platforms, the platform's own terms govern delivery, refunds, and disputes. Sinq Foods is responsible only for food preparation. Delivery or missing-item queries should be directed to the relevant platform.

9. Claims and Complaints

Any claim must be notified in writing within a reasonable time to info@sinqfoods.com.au. We will acknowledge all complaints within 2 business days and aim to resolve them within 7 business days.

10. Governing Law

These Terms are governed by the laws of Victoria and the Commonwealth of Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

11. Privacy

Sinq Foods Pty Ltd handles personal information in accordance with the Privacy Act 1988 and the Australian Privacy Principles. We collect personal information only as necessary to provide our services and will not share it with third parties except as required by law or to fulfil your order.
